1. Agreement to terms

These Terms of Service govern your access to and use of the Moonrise Radio website at moonriseradio.com and the Moonrise Radio live audio stream (together, the "Service"). By using the Service, you agree to these Terms. If you do not agree with any part of them, please do not use the Service.

2. About the Service

Moonrise Radio is an independent, non commercial online radio station broadcasting relaxing Balearic chillout, lounge, downtempo and ambient music on a continuous 24/7 basis. The Service is free, needs no registration and is intended for personal listening.

3. Eligibility

The Service is available to anyone with a compatible internet connected device. You confirm that you are of legal age to form a binding contract in your country of residence, or that you use the Service under the supervision of a parent or legal guardian.

4. Use of the Service

4.1 Permitted use

You are welcome to listen to the Moonrise Radio live stream for personal enjoyment on any number of devices. You may also share links to moonriseradio.com with friends, on social media or in online communities.

4.2 Prohibited use

You agree not to:

• Rebroadcast, retransmit or embed the live stream on commercial platforms without prior written permission
• Download, record, capture or redistribute individual tracks from the stream
• Use automated tools such as bots, scrapers or crawlers to overload the Service
• Attempt to reverse engineer, probe or circumvent any technical protections
• Use the Service in any way that violates applicable law or the rights of third parties
• Misrepresent your affiliation with Moonrise Radio or use our name, logo or branding without permission

5. Intellectual property

5.1 Our content

All original content on moonriseradio.com, including the Moonrise Radio name, logo, design, written copy and the curated programming of the live stream, is the property of Moonrise Radio or its licensors and is protected by copyright and other intellectual property laws.

5.2 Music rights

The music broadcast on Moonrise Radio consists of productions that we own, produce or have the right to broadcast. Listening to the stream does not transfer any ownership rights in the music to you.

5.3 Third party trademarks

All other trademarks mentioned on the site, for example TuneIn, OnlineRadioBox, Streema and YouTube, are the property of their respective owners.

6. Third party links and services

The Service contains links to third party websites, platforms and radio directories. Moonrise Radio is not responsible for their content, privacy practices or policies. Using third party services is at your own risk and subject to their own terms.

7. Availability and changes

We aim to keep Moonrise Radio broadcasting continuously, but we do not guarantee uninterrupted or error free service. The Service may occasionally be unavailable because of maintenance, technical issues or circumstances beyond our control. We may modify, suspend or discontinue any part of the Service at any time.

8. Disclaimer

The Service is provided "as is" and "as available". To the fullest extent permitted by law, Moonrise Radio disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non infringement. We do not warrant that the stream will be free of interruptions, errors or buffering.

9. Limitation of liability

To the fullest extent permitted by law, Moonrise Radio, its owner, contributors and affiliates are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Service. Our total liability for any direct damages shall not exceed the amount you paid to access the Service, which, since the Service is free, is zero.

10. Indemnification

You agree to indemnify and hold harmless Moonrise Radio and its owner from any claims, damages, liabilities, losses, costs or expenses, including reasonable legal fees, arising from your violation of these Terms or misuse of the Service.

11. Governing law

These Terms are governed by the laws of Romania, the country of origin of Moonrise Radio, without regard to conflict of law principles. Any dispute shall be resolved by the competent courts of Romania, unless mandatory consumer protection laws in your country of residence require otherwise.

We may update these Terms from time to time. When we do, we will update the date at the top of this page. Continued use of the Service after changes means you accept the updated Terms.
